Can you build on farmland in Vietnam? The rules in brief

Can you build on farmland in Vietnam? A summary of published rules, homes versus farm structures, and the risks of building without permission.

Can you build on farmland in Vietnam? It is the question buyers of orchards and upland plots ask most. The short answer: you may not simply build a home on agricultural land. This article only summarises published rules so you understand the general framework. datnongnghiep.com does not advise on changing land use for individual cases; ask the commune office and land authority where the land is.

The principle: use land for its stated purpose

Vietnam's Land Law requires land users to use land for the purpose stated on the certificate. Rice land, annual-crop land and perennial-crop land are for farming. To build a home, the land must be residential land. So if the plot you buy is farmland only, owning it does not give you the right to build a house on it.

Who decides on a change of land use?

Converting farmland to residential land requires permission from the competent authority, based on local land use plans. If approved, the user files the paperwork and pays the financial obligations set by law. Some areas allow it and some do not, depending on planning. Therefore:

  • Nobody, including the seller or a broker, can promise that a plot "will become residential".
  • To find out whether a plot lies in an area where conversion is possible, ask the commune office.
  • Costs and procedures are set out by the authorities under the rules in force.

Farm structures are different from homes

The law distinguishes homes from structures that directly serve farming, such as greenhouses, produce stores and animal sheds. These also have their own rules on land type, scale and procedure. Before putting up a permanent hut, store or shed, ask the commune what is required so you do not face enforcement later.

What you want to doWhat to ask
Build a homeCan the plot become residential, and how
Put up a store, shed or greenhouseIs registration or a permit needed, what size is allowed
Dig a pond or build a farm trackDoes it affect the permitted land use

The risks of building without permission

Building on farmland without permission can lead to administrative fines and an order to restore the land to its original state. An unauthorised house is also hard to have recognised, hard to resell and hard to mortgage. Anyone buying a plot that already has a house on farmland should ask whether that house has been recognised and whether the title records it.

Questions to ask before you pay

When a seller says a plot can take a house, ask to see it in writing: is there a residential portion on the title, has a building permit ever been issued, has the commune confirmed the plot lies in an area planned for residential use? Visit the commune office yourself with the parcel number rather than relying on photocopies the seller provides. If the answers are vague, treat the land purely as farmland and price it accordingly. It is far cheaper to ask a few questions now than to discover after the sale that the house you planned cannot be built.

How to buy farmland sensibly

Buy farmland for its farming value: good soil, water and access. If you need somewhere to live, choose a plot whose title already includes some residential land, or buy residential land separately. Before any deposit, read buying farmland in Vietnam and browse the farmland search by province. Foreign readers should note that foreign individuals cannot acquire land use rights in Vietnam.

Meanwhile: farm it and look after it

While you look into procedures, you can farm the land as intended. Where there is no power, solar lights are a simple way to light a hut; see solar lights. Vegetable seeds and fast-growing fruit trees bring early income; see seeds and seedlings. Taking dated photos of the land from time to time also gives you evidence if a boundary dispute ever arises.
